GENERAL TERMS AND CONDITIONS OF THE SALE OF TICKETS
ALTIBUS RESERVATION CENTRE

Article 1er. DÉFINITIONS

Each of the terms mentioned below, in these general terms and conditions (hereinafter “the General Terms and Conditions”), has the following meaning:

“Altibus”: The Company Altibus.com, a limited liability company with a capital of €30,500, registered in the national companies register under the number 440 797 371 and registered in this respect at the office of the clerk of the commercial court of CHAMBERY, the registered office of which is located at 926, avenue de la Houille Blanche 73000 CHAMBÉRY

“Classic ticket”: refers to paper/cardboard tickets that are to be reserved latest by 7 days before departure; they are sent to the Customer via post to his/her residence; the payment is made by cheque (refer to Article 5.3) or by credit card if the reservation is made by telephone, and only by credit card if the reservation is made online via www.altibus.com.

“e-Tickets”: refer to Tickets in the electronic format (PDF), reserved on the website www.altibus.com  and paid for via credit card.

For the regular lines of the Belle Savoie Express network (except for the line departing from the Chambéry airport), reservations can be made until the time of departure, subject to availability of places on board the coaches.

For the lines departing from the Chambéry, Geneva and Lyons airports, reservations can be made until the time of departure, subject to the availability of places on board the coaches, going in the direction Airport – Ski resorts. In the direction of the Ski Resorts or bus terminals towards the airports, the ticket must be reserved latest by 48 hours before departure on the website www.altibus.com by selecting “e-ticket”.

For the other regular lines, the ticket must be reserved latest by 2 days before the date of departure at www.altibus.com by selecting “e-ticket”.

They are sent by email to the electronic address indicated by the Customer; the payment can only be made via credit card.

The e-tickets and classic tickets can be modified pursuant to the conditions given in Article 7 of these General Terms and Conditions of Sale.

The e-Tickets can be refunded pursuant to the conditions given in Article 8 of these General Terms and Conditions of Sale.

“Carrier”: Passenger transport company offering transportation between the bus terminals and winter sport resorts, which has entrusted Altibus with the marketing of certain of its transport documents, which can therefore be purchased via the Altibus Reservation Centre in the territory falling under its coverage.

“Reservation Centre”: Service presenting the transportation offers of Carriers referenced by Altibus and for the sale and shipping, in the name of and on behalf of these Carriers, of transport documents issued for them. This service includes transportation services between the bus terminals and the winter sports stations selected by Altibus. It is provided by Altibus and can be accessed online via the Altibus.com Portal or by telephone via the Customer Care Centre operators.

“Altibus.com Portal”: A whole unit comprising the websites of the Carriers and Altibus, which allows accessing the services of the Reservation Centre.

“Customer Care Centre”: A Centre that receives the calls from Customers who wish to access the services of the Reservation Centre by telephone.

“Customer”: An individual, not acting in any professional capacity, who uses the service of the Reservation Centre. The Customer affirms that he/she has the ability to comply with the General Terms and Conditions, i.e. he/she has attained the age of legal majority and is not under tutorship or guardianship.

“Transport document or Ticket(s)”: Equally refers to: Classic Tickets or e-Tickets.

Article 2. PURPOSE

 2.1 The objective of the General Terms and Conditions is to provide the conditions for providing Customers with the Reservation Centre service, as defined in Article 1 hereinabove (presentation of the offers of Carriers, sale and shipping of their tickets). They are applicable to all of the orders placed with the Carriers via the Altibus Reservation Centre.

The purpose of the General Terms and Conditions is not to govern the conditions of the transportation contracts concluded between the Customers and each Carrier via Altibus, which are governed by the transportation conditions specific to each Carrier concerned, as is mentioned in Article 9 hereinafter.

2.2. Placing orders for Transport documents via the Altibus Reservation Centre is reserved for only those Customers who have read and accepted the General Terms and Conditions, by clicking on the Altibus.com Portal or by giving their verbal agreement by telephone.

By proceeding with the payment of his/her order, the Customer affirms that he/she unreservedly accepts the General Terms and Conditions in their entirety.

Article 3. DESCRIPTION AND AVAILABILITY OF THE SERVICE

 3.1    Altibus provides the Customers with a system for consulting the offers of different Carriers concerning transportation services that they carry out between the bus terminals and the regional airports and the winter sports resorts.

These offers mainly specify the projected routes (place of departure-destination, date, timings) and the applicable tariffs.
The Customer, after having been informed of the transport offers as well as the General Terms and Conditions of Sale on the Portal, is able to purchase and pay for the selected Transport documents.

3.2    The Altibus Reservation Centre Service can be accessed online via the Altibus.com Portal 24/7. However, due to the very nature of the Internet, Altibus cannot guarantee an uninterrupted functioning of the Service and therefore disclaims all responsibility in this respect.

Similarly, it is not guaranteed that the Altibus Portal is free from any computer anomalies or errors (bugs), or that these bugs can be corrected. It is not guaranteed that the site will function without any interruptions or breakdowns, or that it will be compatible with a particular hardware or configuration other than those specifically confirmed by Altibus.

Under no circumstances will Altibus be responsible for any type of predictable or unpredictable damage resulting from the use of the Altibus Portal, or the complete or partial impossibility to use it.

The Customer acknowledges that he/she knows the characteristics and limits of the Internet, especially its technical performances, the response time for viewing, querying or transferring data and the risks related to communications security.

The Customer declares that he/she has checked the computer configuration that he/she uses to ensure that it does not contain any virus and that it is in a perfect state of operation.

The Customer acknowledges and expressly declares that he/she relinquishes any claim for any possible direct or indirect harm that could result from an interruption in the service.

3.3. The Altibus Reservation Centre service can also be accessed by telephoning the Customer Care Centre, on working days, in the winter season from Monday to Saturday, 08:00 a.m. to 06:30 p.m. and in the shoulder season from Monday to Friday, 08:00 a.m. to 06:30 p.m. and on Saturday, 08:00 a.m. to 12:00 noon and 01:30 p.m. to 05:00 p.m.

Article 4. PLACING ORDERS AND SENDING OF TICKETS

 4.1    The Customer cannot place an order for Transport documents via the Reservation Centre beyond a minimum period of 7 days before the chosen date of departure for Classic Tickets, of 2 days before the selected date of departure or at the last minute for e-tickets (Article 1 – “e-Tickets”).

 4.2    The Customer can place his/her order by telephone via the Customer Care Centre or online via the Altibus.com Portal.

In all cases, he/she has to make the following choices:

  • places of departure and arrival
  • dates and timings
  • number of travellers and the age of the travellers

The Customer must then provide certain information (mainly on the identity of the travellers); he/she undertakes to provide reliable and authentic information in all stages of placing the order.

4.3    If an order is placed via the Altibus.com Portal, the Customer will mark his/her acceptance of the General Terms and Conditions of Sale by selecting the box meant for this purpose.

 At the end of placing the order, a summary is shown to the Customer. The latter can then confirm his/her order by clicking the corresponding box and continuing to the online payment step.

After the order is placed, he/she will receive an email confirming his/her order.

 For information purposes only, on selecting the “e-Ticket – sent by email” option, the e-Ticket is generated and sent automatically to the email address of the Customer instantaneously. However, certain technical constraints could slow down the process and it may take up to a few hours for the Customer to receive the e-Ticket. In case of any anomaly or if the e-Ticket is not received by email, the Customer is requested to contact the Customer Care Centre before his/her departure.

 The Customer must show his/her e-Ticket when entering the Coach. He/she must preserve it for the entire duration of the journey. The e-Ticket can either be printed on an A4 sheet of paper or shown on an electronic medium (smartphone, tablet, etc.), provided that it is perfectly legible. Any illegible e-Ticket (due to poor printing or battery failure of the smartphone) shall be rejected and the Customer must acquire a new transport document to travel. At the Geneva and Lyon airports, forgetting to print your e-Ticket will cost you €5 for this service.

If the Classic Ticket is sent via post, the Customer will receive, via email, a summary of his/her order, which will contain the order number, the description of the order as well as a copy of the General Terms and Conditions of Sale.
The order confirmation cannot be used as a ticket.

4.4. If an order is placed by telephone via the Customer Care Centre, the operator will give a verbal summary of the order to the Customer, who must accept it for the order to be effectively registered. An order number will also be communicated to him/her.

The Transport document(s) shall be sent via a simple letter to the Customer, to the delivery address mentioned at the time of placing the order, as soon as Altibus receives the payment of the order from the Customer.

If the Transport documents are not received by the Customer, he/she is requested to contact the Customer Care Centre within a sufficient period before his/her departure.

Article 5. FINANCIAL CONDITIONS

 5.1    The tariffs of the Carriers mentioned on the Altibus.com Portal or by the Customer Care Centre operators are expressed in Euros, inclusive of all taxes (TTC or toutes taxes comprises).

The Carrier tariffs are subject to change:

  • for the lines of the Belle Savoie Express network: once a year in September
  • for the other lines: depending on the requests of the Carriers concerned.

 The tariff applicable to a given order is the one applicable on the date of the journey.

 5.2    Payment for the orders placed via the Altibus.com Portal can be made exclusively via credit card, through a SSL secure payment system. In fact, Altibus has adopted SSL encryption, which ensures the reliability of the exchanges and transactions by encrypting, when inputted, all personal data that is necessary to process the orders, such as addresses, emails, bank account details, etc. Accepted credit cards are identified by an icon at the time of the payment.

 5.3    The orders placed via the Customer Care Centre are payable, either by credit card when placing the order, or by a bank cheque made out to Altibus, sent after the order is placed to the following address: 926, Avenue de la Houille Blanche 73000 CHAMBERY.

 5.4    Irrespective of the mode of payment, the Transport documents are only sent after the full payment of the price of the order.

Article 6. FINAL ORDER – PROOF OF THE ORDER

 6.1    Pursuant to Article L121-16-1)9° of the Consumer Code, the seven-day cancellation period is not applicable to orders placed pursuant to these Conditions.

 The Customer’s order is fixed, final and irrevocable, once the price is paid by the Customer, subject to what has been mentioned in Articles 7 and 8 hereinafter.

6.2    By express agreement, the data from the computer system of Altibus constitutes writings as defined by Article 1316-1 of the Civil Code, with the link between this data and the Customer to whom it pertains being presumed, unless otherwise proved. It therefore constitutes proof between the Parties and can be used as evidence against them in the same manner, pursuant to the same conditions and with the same probative value as any document written and signed on paper by the Parties.

Article 7. MODIFICATIONS

As an exception to what has been mentioned in Article 6 hereinabove, the Customer can request to change the time and date of his/her reservation in certain cases:

  • as concerns Classic Tickets sent by Altibus via post: till the 7th day (inclusive) before the date of the journey
  • as concerns (e-Tickets), the Customer must contact the Customer Care Centre, to which he/she must communicate his/her order number as well as the desired modifications.

 For the regular lines of the Belle Savoie Express network (except for the line departing from the Chambéry airport), modifications can be made until the day before the departure by calling the Altibus Reservation Centre (+ 33 4 79 68 32 96), subject to availability of places on board the coaches at the new timing. Modifications for Monday or the day after a holiday must be made 2 days before departure.

For the lines departing from the airports of Chambéry, Geneva and Lyon, modifications can be made latest by 48 hours before departure by calling the Altibus Reservation Centre (+ 33 4 79 68 32 96),

For the other regular lines, the ticket can be modified at the latest 2 days before the date of departure by calling the Altibus Reservation Centre (+ 33 4 79 68 32 96),

 Altibus will do its best to carry out the desired modification, depending on the availability of the Carriers concerned. However, Altibus cannot guarantee that the modification will be made in all cases.

If the desired modifications involve a refund (any change other than the time and date), the terms of this refund are given in Article 8 hereinafter.

Article 8. CANCELLATION AND REFUNDS

 8.1. As an exception to what has been mentioned in Article 6 hereinabove, in the case of an order placed via the Reservation Centre for Classic Tickets shipped by Altibus, the Customer can cancel his/her reservation by letter or email only, and request for a refund of the sums paid in exchange for the Transport documents purchased according to the General Terms and Conditions of sale on the website www.altibus.com. The cancellation request will be taken into account on receiving the letter from the Customer.

The reservation fees (or handling charges) are not refunded.

 Conditions for the cancellation of sold Tickets, except for the Airport lines:

  • More than 15 calendar days before departure: Full refund minus reservation fees
  • 8 to 14 calendar days before departure: Refund of 50% of the cart minus reservation fees
  • 7 calendar days before departure: Ticket(s) not refundable

Conditions for the cancellation of Tickets sold for departures from the airports of Lyon, Geneva and Chambéry:

  • More than 15 calendar days before departure: Refund of 95% of the cart
  • 8 to 15 calendar days before departure: Refund of 85% of the cart
  • Less than 7 calendar days before departure: refund of 50% of the cart

No refund for a Classic Ticket will be made if the date of receipt of the written cancellation request is after the planned date of the journey or journeys. Due to the Covid-19 situation, you can ask for reimbursement up to 60 days after the departure day using this form. Any journey booked from 11 May 2020 onwards is not affected by this exceptional scheme.

The Classic Tickets attached to the cancellation request letter may not have any modifications, crossing-out or deletions (especially of the detachable coupon). This is a condition precedent to the refund.

Round-trip Tickets cannot be separated.

 8.2.    For orders of e-Tickets, they are similar to classic tickets and the provisions of Article 7 are applicable; therefore, these Tickets can be refunded pursuant to the conditions given in point 8.1 hereinabove “Conditions for the cancellation of the tickets sold for departures from airports”.

Article 9. THE RESPECTIVE TASKS OF ALTIBUS AND THE CARRIER – TRANSPORT CONDITIONS

 The Customer acknowledges that Altibus is not responsible for the transportation of the Customer, but only for the Reservation Centre service and the sale described in Article 3; therefore, its task is limited to the selling of Tickets of the Carriers concerned.

 Therefore, the Customer acknowledges that:

  • Altibus has completely fulfilled its obligations by handing over to the Customer the Transport documents compliant with the summary of the order sent by email to the Customer as part of an order on the Portal, or communicated verbally by the operator as part of a telephonic order
  • Altibus does not assume any responsibility as concerns the execution of the transportation, which falls under the exclusive responsibility of the Carriers concerned.

 Accordingly, the Customer undertakes to exclusively approach the Carrier concerned for any dispute or claim related to the conditions of the execution of the transportation.

Article 10. PERSONAL DATA PROTECTION

10.1    Pursuant to the “Information Technology and Liberties” Act, the Altibus.com Portal has submitted a declaration to the CNIL (French Data Protection Authority) under no. 826413.

10.2    The information collected as part of the service of the Reservation Centre is for the exclusive use of Altibus. It allows Altibus to send Tickets to the Customers and inform them of the existence of new services. When booking a journey to Val Thorens, our partner the Tourism Office of Val Thorens might send you non-commercial communications.

10.3    Pursuant to the provisions of the Information Technology and Liberties Act, each Customer has the ability to access the data that he/she inputted at the time of the reservation, to modify it or delete it. The Customer can carry out these operations by sending an email to the address info@altibus.com, or a letter to Altibus, 926, avenue de la Houille Blanche, 73000 CHAMBERY.

  Article 11. FORCE MAJEURE

 Altibus cannot be held liable if the execution of the General Terms and Conditions is delayed or prevented due to a case of force majeure or a fortuitous event, due to the fault of the other Party or a third party or due to external causes such as social conflicts or strikes, the intervention of civil or military authorities, fire, water damage, improper functioning or interruption of the telecommunications network or the electric network.

In all cases, Altibus will do everything in its power to limit the duration and effects of the fortuitous event, the force majeure or the external cause.

Article 12 – INTELLECTUAL PROPERTY

 The information accessible on the Website, especially its interface, the trademarks, texts, images, photographs, maps, sounds and videos are protected by intellectual property rights.

The reproduction or representation of any of this information, in whole or in part, is strictly forbidden without the prior, written authorisation of the owner of the right.

Article 13. MISCELLANEOUS PROVISIONS

 13.1    Altibus reserves the right to unilaterally modify the terms of the General Terms and Conditions. Any new clauses will be applicable to all reservations made after their entry into force, and only the new version will be valid between the parties.

 13.2    The General Terms and Conditions express all of the obligations of the parties. No other general or specific condition may be integrated in the General Terms and Conditions without the express approval of Altibus.

13.3    If one of these provisions is considered to be void pursuant to a current or future legal or regulatory provision, or a legal ruling carrying the authority of the matter judged and issued by a competent court or body, the said provision will be considered to be unwritten, with all of the other provisions of the General Terms and Conditions retaining their binding force on the Parties.

 Article 14. APPLICABLE LAW AND COMPETENT COURT
The General Terms and Conditions are subject to French law. Any related dispute shall be brought before the competent court.
